SCOMET stock and sale authorisation

Public Notice No. 04/2025-26, Dated 06-05-2025

1. Background

The Directorate General of Foreign Trade (DGFT) has amended Paragraph 10.10 of the Handbook of Procedures (HBP), 2023 to revise the operational framework for granting export authorisations under the ‘Stock and Sale’ policy concerning SCOMET items (Special Chemicals, Organisms, Materials, Equipment and Technologies).

2. Broadened Definition of ‘Stockist’

A key feature of the revised policy is the expanded definition of the term ‘Stockist’. As per the amendment, the term now includes:

  • Indian or Foreign Original Equipment Manufacturers (OEMs)
  • Electronic Manufacturing Services (EMS) providers
  • Contract Manufacturers (CMs)

This revision allows greater flexibility and aligns the framework with evolving global manufacturing and distribution practices.

3. Revised Application Process

Exporters seeking authorisation under the updated policy must:

  • Submit applications in Form ANF-10B,
  • Include all supporting documents as specified in the DGFT’s public notice.

These applications will be evaluated by the Inter-Ministerial Working Group (IMWG).

4. IMWG Discretion for Relaxation

The IMWG has been empowered to relax eligibility conditions based on:

  • The description of the SCOMET item,
  • Its end-use, or
  • The profile of the end-user.

This flexibility aims to accommodate specific cases while maintaining adequate export control standards.

5. Post-Authorisation Provisions

Once the authorisation is granted:

  • Exports can be made directly to the approved Stockist.
  • In-principle approval may also be granted for re-export of these items to specified countries, subject to conditions.

This amendment reflects India’s intent to modernize and streamline its export control mechanisms in line with international trade practices and national security considerations. Exporters dealing in SCOMET items should review the revised framework carefully and ensure compliance while availing the expanded operational flexibility.
