1. Background<\/h2>\n

The Directorate General of Foreign Trade (DGFT)<\/strong> has amended Paragraph 10.10 of the Handbook of Procedures (HBP), 2023<\/strong> to revise the operational framework for granting export authorisations under the \u2018Stock and Sale\u2019 policy<\/strong> concerning SCOMET items<\/strong> (Special Chemicals, Organisms, Materials, Equipment and Technologies).<\/p>\n

2. Broadened Definition of \u2018Stockist\u2019<\/h2>\n

A key feature of the revised policy is the expanded definition of the term \u2018Stockist\u2019<\/strong>. As per the amendment, the term now includes:<\/p>\n

    \n
  • Indian or Foreign Original Equipment Manufacturers (OEMs)<\/li>\n
  • Electronic Manufacturing Services (EMS) providers<\/li>\n
  • Contract Manufacturers (CMs)<\/li>\n<\/ul>\n

    This revision allows greater flexibility and aligns the framework with evolving global manufacturing and distribution practices.<\/p>\n

    3. Revised Application Process<\/h2>\n

    Exporters seeking authorisation under the updated policy must:<\/p>\n

    • Submit applications in Form ANF-10B<\/strong>,<\/li>\n
    • Include all supporting documents<\/strong> as specified in the DGFT\u2019s public notice.<\/li>\n<\/ul>\n

      These applications will be evaluated by the Inter-Ministerial Working Group (IMWG)<\/strong>.<\/p>\n

      4. IMWG Discretion for Relaxation<\/h2>\n

      The IMWG has been empowered to relax eligibility conditions<\/strong> based on:<\/p>\n

      • The description<\/strong> of the SCOMET item,<\/li>\n
      • Its end-use<\/strong>, or<\/li>\n
      • The profile of the end-user<\/strong>.<\/li>\n<\/ul>\n

        This flexibility aims to accommodate specific cases while maintaining adequate export control standards.<\/p>\n

        5. Post-Authorisation Provisions<\/h2>\n

        Once the authorisation is granted:<\/p>\n

        • Exports can be made directly to the approved Stockist<\/strong>.<\/li>\n
        • In-principle approval may also be granted<\/strong> for re-export<\/strong> of these items to specified countries<\/strong>, subject to conditions.<\/li>\n<\/ul>\n
