Why a Fresh Notification?<\/h2>\n<p data-start=\"36\" data-end=\"679\">Earlier notifications shifted jurisdiction over <strong data-start=\"84\" data-end=\"129\">100 % Export-Oriented Undertakings (EOUs)<\/strong> from Central Excise to Customs and simultaneously appointed Customs officers as Central-Excise officers. When appellate forums sent back (\u201cremanded\u201d) certain legacy show-cause notices (SCNs) that contained <strong data-start=\"337\" data-end=\"382\">both Customs-duty and Central-Excise duty<\/strong> demands, there was no clarity on <em data-start=\"416\" data-end=\"421\">who<\/em> should redo the adjudication. Notification <strong data-start=\"467\" data-end=\"516\">No. 35\/2025-Customs (N.T.), dated 16 May 2025<\/strong> now plugs that gap by reallocating such remanded SCNs to Customs officers and prescribing monetary-based authority levels.<\/p>\n<h2 data-start=\"1610\" data-end=\"1645\">2. Scope of the Notification<\/h2>\n<ul>\n<li data-start=\"1649\" data-end=\"1842\"><strong data-start=\"1649\" data-end=\"1679\">Covers only remanded cases \u2013<\/strong>\u00a0SCNs that were <em data-start=\"1696\" data-end=\"1708\">originally<\/em> decided by Central-Excise officers <strong data-start=\"1744\" data-end=\"1794\">under Rule 3 of the Central Excise Rules, 2002<\/strong> and later set aside for de-novo adjudication.<\/li>\n<li data-start=\"1845\" data-end=\"1957\"><strong data-start=\"1845\" data-end=\"1878\">Applies to mixed-duty notices \u2013<\/strong>\u00a0The SCN must involve <strong data-start=\"1901\" data-end=\"1909\">both<\/strong> Customs and Central-Excise demands on an EOU.<\/li>\n<li data-start=\"1960\" data-end=\"2261\"><strong data-start=\"1960\" data-end=\"1982\">Prospective effect \u2013<\/strong>\u00a0Takes effect <strong data-start=\"1997\" data-end=\"2029\">from the date of publication<\/strong> in the Official Gazette (16 May 2025). Ongoing de-novo proceedings not yet disposed must switch to the new authority, and appellate bodies are expected to remand future cases directly to the proper Customs officer per the table.<\/li>\n<\/ul>\n<h2 data-start=\"3000\" data-end=\"3032\">3. Practical Implications<\/h2>\n<ul>\n<li data-start=\"3036\" data-end=\"3170\"><strong data-start=\"3036\" data-end=\"3061\">Single-window clarity \u2013<\/strong>\u00a0Eliminates parallel proceedings\u2014one common Customs officer passes a composite order covering both duties.<\/li>\n<li data-start=\"3173\" data-end=\"3303\"><strong data-start=\"3173\" data-end=\"3196\">Speed &amp; consistency \u2013<\/strong>\u00a0Monetary banding mirrors regular Customs adjudication thresholds and should help standardise timelines.<\/li>\n<li data-start=\"3306\" data-end=\"3456\"><strong data-start=\"3306\" data-end=\"3322\">Appeal route \u2013<\/strong>\u00a0Orders will be appealable before the Commissioner (Appeals) or CESTAT under the Customs Act, streamlining the appellate hierarchy.<\/li>\n<\/ul>\n<h2>4. Conclusion<\/h2>\n<p>From 16 May 2025, any EOU show-cause notice that was earlier decided by Central-Excise officers, got remanded, and involves <strong data-start=\"3604\" data-end=\"3642\">both Customs and Excise components<\/strong> must be freshly adjudicated <strong data-start=\"3671\" data-end=\"3713\">only by the designated Customs officer<\/strong> as per the new duty-based slabs.
