Umesh Rao<\/span><\/strong>, Senior Standing Counsel, for the Respondent<\/i><\/li>\n<\/ul>\n<h2><em>Facts of the Case<\/em><\/h2>\n<p><span class=\"TextRun SCXW164257906 BCX0\" lang=\"EN-IN\" xml:lang=\"EN-IN\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW164257906 BCX0\">Universal <\/span><span class=\"NormalTextRun SCXW164257906 BCX0\">Impex<\/span><span class=\"NormalTextRun SCXW164257906 BCX0\"> imported areca nuts declaring them as \u201croasted areca nuts.\u201d The Revenue treated the goods as \u201craw areca nuts\u201d and ordered confiscation for <\/span><span class=\"NormalTextRun SCXW164257906 BCX0\">misdeclaration<\/span><span class=\"NormalTextRun SCXW164257906 BCX0\">. The petitioner relied on the Advance Ruling Authorities\u2019 decision, upheld by the High Court, which fixed the moisture content of roasted areca nuts below 10%. Lab reports from CRCL (Chennai), FSSAI and Indonesia confirmed moisture content below 10%, but Revenue ignored these and relied on a contrary report from CRCL (Delhi). The petitioner contended that raw areca nuts could not survive for long without fungus, <\/span><span class=\"NormalTextRun SCXW164257906 BCX0\">whereas<\/span><span class=\"NormalTextRun SCXW164257906 BCX0\"> the goods had <\/span><span class=\"NormalTextRun SCXW164257906 BCX0\">remained<\/span><span class=\"NormalTextRun SCXW164257906 BCX0\"> intact even after a year, proving them to be roasted.<\/span><\/span><span class=\"EOP SCXW164257906 BCX0\" data-ccp-props=\"{&quot;201341983&quot;:1,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:0,&quot;335559740&quot;:280}\">\u00a0<\/span><\/p>\n<h2><i>High Court Held<\/i><\/h2>\n<p><span class=\"TextRun SCXW174308014 BCX0\" lang=\"EN-IN\" xml:lang=\"EN-IN\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW174308014 BCX0\">The Madras High Court allowed the petition, holding that the parameters fixed by the Advance Ruling Authorities had <\/span><span class=\"NormalTextRun SCXW174308014 BCX0\">attained<\/span><span class=\"NormalTextRun SCXW174308014 BCX0\"> finality and were binding on the Revenue. Since all laboratory reports showed moisture content below 10%, the goods were clearly roasted areca nuts. The Revenue acted in non-application of mind by ignoring scientific reports and binding <\/span><span class=\"NormalTextRun SCXW174308014 BCX0\">rulings, and<\/span><span class=\"NormalTextRun SCXW174308014 BCX0\"> overstepped its <\/span><span class=\"NormalTextRun SCXW174308014 BCX0\">jurisdiction<\/span><span class=\"NormalTextRun SCXW174308014 BCX0\"> while passing the order.
