Policy Circular No. 06\/2025-26<\/a>, Dated 27-10-2025<\/p>\n

1. Background<\/h2>\n

The Directorate General of Foreign Trade (DGFT)<\/strong> has issued a circular<\/strong> clarifying the scope and applicability of import restrictions on Silver Jewellery<\/strong>, as imposed vide Notification No. 34\/2025-26, dated 24 September 2025<\/strong>.<\/p>\n

The clarification aims to ensure uniform understanding and enforcement of the import restrictions among stakeholders, including Customs field formations, 100% Export Oriented Units (EOUs), and Special Economic Zone (SEZ) units<\/strong>.<\/p>\n

2. Import Restrictions under Notification No. 34\/2025-26<\/h2>\n

Notification No. 34\/2025-26 introduced import restrictions<\/strong> on specified categories of Silver Jewellery<\/strong>, particularly items falling under ITC (HS) Codes 71131141 and 71131149<\/strong>.<\/p>\n

These restrictions were imposed as part of trade management measures to monitor the inflow of precious metal jewellery into India\u2019s domestic market.<\/p>\n

3. Clarification on Exemptions for EOUs and SEZ Units<\/h2>\n

The DGFT has clarified that:<\/p>\n

  • \n

    Imports of Silver Jewellery<\/strong> under the above ITC (HS) codes by:<\/p>\n<\/li>\n<\/ul>\n

      \n
    1. \n
        \n
      1. 100% Export Oriented Units (EOUs)<\/strong>, and<\/li>\n
      2. Units located in Special Economic Zones (SEZs)<\/strong>
        shall not be subject to the import restrictions<\/strong> imposed under Notification No. 34\/2025-26.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n

        This exemption aligns with the provisions of the Foreign Trade Policy (FTP), 2023<\/strong> and the Special Economic Zones Rules, 2006<\/strong>.<\/p>\n

        However, DGFT has emphasised that such imports cannot be sold in the Domestic Tariff Area (DTA)<\/strong> and must be utilised strictly for authorised operations within the EOU\/SEZ framework.<\/p>\n

        4. Exemption for Imports under Advance Authorisation and DFIA Schemes<\/h2>\n

        Further, DGFT has clarified that imports made under the following export-promotion schemes are also exempt from the said import restrictions<\/strong>:<\/p>\n

        • Advance Authorisation Scheme<\/strong>, and<\/li>\n
        • Duty-Free Import Authorisation (DFIA) Scheme<\/strong>.<\/li>\n<\/ul>\n

          This exemption is available in accordance with Para 4.18(iv)<\/strong> of the Foreign Trade Policy, 2023<\/strong>, which allows duty-free imports of inputs required for the manufacture of export products, subject to fulfilment of export obligations.<\/p>\n

          5. Directions to Field Formations<\/h2>\n

          The circular directs all Customs field formations<\/strong> to take note of these clarifications and ensure uniform implementation<\/strong> of the policy.
          It instructs authorities to:<\/p>\n

            \n
          • Facilitate legitimate imports by EOUs, SEZs, and authorised exporters, and<\/li>\n
          • Prevent misuse of exemptions or diversion of imported goods into the domestic market.<\/li>\n<\/ul>\n

            6. Consequences of Non-Compliance<\/h2>\n

            DGFT has explicitly stated that any deviation<\/strong> from the prescribed policy provisions will attract penal action<\/strong> under the applicable laws, rules, and regulations<\/strong> governing foreign trade and customs.<\/p>\n

            7. Conclusion<\/h2>\n

            Through this clarification, DGFT has reinforced that while import restrictions on Silver Jewellery<\/strong> remain applicable to regular imports, EOUs, SEZ units, and authorised exporters<\/strong> under the Advance Authorisation and DFIA schemes<\/strong> are exempt, provided the imports are used strictly for their intended purposes.<\/p>\n
