1. Background<\/h2>\n

The Directorate General of Foreign Trade (DGFT)<\/strong> has issued a Public Notice<\/strong> amending Paras 2.88(a)<\/strong> and 2.91<\/strong> of the Handbook of Procedures (HBP), 2023<\/strong>, to incorporate provisions related to the recently concluded India\u2013European Free Trade Association Trade and Economic Partnership Agreement (India-EFTA TEPA)<\/strong>.<\/p>\n

These amendments align India\u2019s trade facilitation framework with the operational requirements of the new trade agreement and aim to provide greater flexibility and convenience to Indian exporters.<\/p>\n

2. Amendment to Para 2.88(a) \u2013 Inclusion of India-EFTA TEPA<\/h2>\n

A new entry titled \u201cIndia-European Free Trade Association Trade and Economic Partnership Agreement (India-EFTA TEPA)\u201d<\/strong> has been added under the list of Free Trade Agreements (FTAs)<\/strong> in Para 2.88(a)<\/strong> of the Handbook of Procedures.<\/p>\n

This inclusion formally recognises India-EFTA TEPA within the DGFT\u2019s procedural framework, thereby enabling exporters and importers to claim preferential tariff benefits<\/strong> under this agreement, subject to fulfilment of the prescribed origin and documentation requirements.<\/p>\n

3. Amendment to Para 2.91 \u2013 Certificate of Origin under India-EFTA TEPA<\/h2>\n

A new sub-paragraph<\/strong> has been inserted under Para 2.91<\/strong> of the HBP, 2023, to introduce an additional method for obtaining Certificates of Origin (CoO)<\/strong> in respect of exports made under the India-EFTA TEPA.<\/p>\n

As per the amendment:<\/p>\n

    Exporters may obtain the Certificate of Origin<\/strong> through either of the following modes:<\/p>\n<\/li>\n<\/ul>\n

    1. \n
        \n
      1. Self-declaration<\/strong> by the exporter concerned, or<\/li>\n
      2. Issuance by an authorised agency<\/strong> designated under the Foreign Trade Policy (FTP).<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n

        This dual mechanism enhances procedural flexibility by allowing trusted exporters<\/strong> to self-certify origin, while still retaining the traditional agency-based system<\/strong> for those preferring the conventional route.<\/p>\n

        4. Objective and Impact<\/h2>\n

        The amendments aim to:<\/p>\n

          \n
        • Facilitate trade<\/strong> under the newly concluded India-EFTA TEPA,<\/li>\n
        • Simplify documentation<\/strong> and reduce procedural delays for exporters,<\/li>\n
        • Align domestic procedures<\/strong> with international best practices on origin certification, and<\/li>\n
        • Promote ease of doing business<\/strong> through self-declaration options.<\/li>\n<\/ul>\n

          By allowing exporters to self-declare origin<\/strong>, the DGFT empowers compliant and credible exporters while maintaining the necessary checks through authorised agencies.<\/p>\n

          5. Conclusion<\/h2>\n

          Through this Public Notice, the DGFT has amended the Handbook of Procedures 2023<\/strong> to operationalise provisions of the India-EFTA TEPA<\/strong>, offering exporters the flexibility to obtain Certificates of Origin<\/strong> either via self-declaration<\/strong> or through authorised agencies<\/strong>.<\/p>\n
