Facts of the Case

The applicant was one of the partners of a firm. A search was conducted at the business premises of the applicant. The search concluded with the allegation that the applicant had not paid GST amounting to Rs. 4.37 Crores. Subsequently, the applicant was arrested by the DGGI. In response, the applicant filed an application for regular bail before the Gujarat High Court.

High Court Held

The High Court held that substantial investigation was complete, and no past antecedents were registered against the applicant. The applicant had deposited Rs. 84 lakh before the GST Department. He also had deep roots in society, and there was no apprehension of fleeing, escaping trial or tampering with evidence or witnesses. Accordingly, the High Court granted regular bail to the applicant.
