Instruction No. 12/2025-Customs, Dated 22-05-2025

1. Purpose of the CBIC Instruction

Speed-up clearance and export of seized/confiscated Red Sanders to:

  • Reduce warehouse congestion and quality deterioration
  • Avoid prolonged litigation/inaction
  • Realise revenue for the Consolidated Fund of India

2. Mandatory Procedural Flow

  • Inventory & Allocation
    1. Segregate consignments fit for export.
    2. Allot each batch to a PSU/STC/STE with DRI concurrence.
  • Tendering & Price Discovery
    1. Agency floats global tender/e-auction.
    2. Bid evaluation → RPC finalises reserve/sale price.
  • Regulatory Clearances
    1. Obtain DRI authorisation (Annex-B) for each shipping bill.
    2. Secure MoEFCC species-export certificate and CITES permit (if required).
  • Documentation & Export
    1. File shipping bill in ICEGATE with Annex-B.
    2. Ensure container sealing, electronic tracking, and destination reporting.
  • Revenue Remittance & Reporting
    1. Sale proceeds remitted to Govt. account.
    2. Post-export report to CBIC & MoEFCC within 15 days.

3. MoEFCC Guideline Highlights (12-Sep-2022)

  • Export only in log/semi-processed form specified by MoEFCC.
  • End-use declaration from overseas buyer mandatory.
  • One-time authorisation per consignment—no split shipments.
  • Quarterly export summary to MoEFCC & CITES Management Authority.

4. Immediate Action Items for Customs Formations

  • Day-0 to Day-7 | Verify seizure orders are final; compile lot-wise inventory with photographs.
  • Day-7 to Day-15 | Liaise with DRI to allocate lots, obtain initial Annex-B authorisation.
  • Day-15 to Day-45 | Engage nominated PSU/STC/STE, float tender, forward bids to RPC.
  • Day-45 onward | File shipping bill, arrange loading & export; complete post-export compliance.

5. Compliance Guard-Rails

  • NO shipment without DRI Annex-B authorisation and MoEFCC certificates.
  • Follow sealed-route movement to the port to curb pilferage.
  • Maintain chain-of-custody records for five years.
  • Report any court stay/injunction to CBIC within 24 hours.
